- As an object of the Terms and Conditions of Use, all services that are furnished under the name Gangwars by that, in the imprint of named operator are defined. Please read these Terms of Use carefully before using this site. By using this site, you signify your agreement with these Terms of Use. If you do not agree with any of the below Terms of Use, do not use this site.
- The coverage of the terms and conditions of use comprises all services and in addition all communication platforms, especially the IRC Channel placed by the QuakeNet provided IRC-Channel #gangwars.de.
- The terms and conditions of use are in the case the IRC Channels #gangwars.de an expansion of the guidelines valid there.
- The terms and conditions of use can be changed at any time by the operator. If the operator changes the terms and conditions of use all users will first be informed. The user has then the possibility to agree or to decline to this. If the user declines the Account will be irrevocably deleted.
- The operator guarantees its Internet infrastructure will be attainable for 98.5% over the year. Hereof excluded are times in which the attainability on the basis of technical or other problems that lie not in the sphere of influence the operator, (higher force, third party fault etc.) or for maintenance purposes to avoid longer term system losses.
- So Far the operator free service provides has the user on its provision no fulfilment claim. The operator is authorized to adjust, to change such services placed previously compensation-freely to the decree within a time period by 24 hours or to offer only against remuneration. In this case, the operator informs the user immediately.
- Without written agreement the provider will grant exclusive free technical support to the user over the Ticketing-System (Supportformular). A claim to support in the IRC Channel #gangwars.de in the QuakeNet does not exist.
- So long as is not been in writing differently agreed they may attain or let the operator carry out the obliged requirements also by expert colleagues or delegated third party.
- No one, with exception §3 sec.3), has a legal claim participant in the online game Gangwars. The operator of the game reserves himself the right of an Account deletion without explanation. Especially in the case of offences against the terms and conditions of use.
- User with Accounts by §3 sec.3) can be excluded only in proof of the offence against the terms and conditions of use. As proof also an indication of a chain of conclusive evidence is sufficient for the operator to justify termination. §3 Registrations, account types and compensation
- Free Account: As far as has not been otherwise arranged or meets §2 sec. 5) the operator makes available all previous account holders of free accounts this also to its automatic cancellation or the cancellation because of offense against these terms and conditions of use, general right and custom.
- Premium Account: The Premium Account is an expansion of the free Accounts after §3 sec.1: The user has the possibility to acquire a so called Premium Account. Current prices, Features and running times are updated permanently on the Internet at http://www.gangwars.de/gangwars/premacc.php. The running time of a Premium Account begins with the free control as a premium player in the system and ends as arranged. An extension of the running time through illness, vacation, system contingent losses or other influences, that do not lie in the control of the operator established agreement, counts with conclusion of the Premium Accounts specifically as not arranged.
- Pay Cities Account: Every user can register in respectively up-to-date opened pay cities. The respective prices, features and running times are to be found at this location. http://www.gangwars.de/gangwars/premacc.php. The running time of the Pay Cities Account begins with the free control of the user in the system and ends running time as arranged. An extension of the running time through illness, vacation, system contingent losses or other influences, that do not lie in the free will of the operator established, counts with conclusion of the Pay Cities Account specifically as not arranged.
- Round Based version (Gangwars: the Mission): A Premium Account finishes automatically at end of the game time (after 12 months). Any overrun time cannot be refunded.
- Should it come that a user who has retained a Premium Account order via Call2Pay and because of a missing payment from the user at the Call2Pay Provider this leads to a cancellation we retain the right for the unlocking of the concerned account to demand a handling charge of €3.00.
- All data is property of the operator
- With the registration in Gangwars, the partner explains himself therewith agreed that the indicated data is electronically stored by the operator in the user database. The operator stores the data for game technical purposes and deletes this with termination of the game accounts.
- By request from the user all stored data is deleted. This leads to an automatic cancellation of the game accounts. To this end an e-mail should be sent to Gangwars under statement of the user Id and the delete wish at accountloeschung@gangwars.de
- Every user is alone responsible for their game data. User whose accounts have been accessed and manipulated by a third party with knowledge of password, user name and/or e-mail address have no right to reimbursement or replacement or restoration of possibly manipulated data or the accounts themselves. If the strange user with this account offends against the terms and conditions of use the owner is seen as for that responsible and is punished in accordance with punishment catalogue.
- Every user explains with recognition of the terms and conditions of use, that he/she agrees that the from the operator designated persons, here Mods and Administrators, have insight on people-related data to the extent of the necessary actions and directions.
- All data are treated through the operator with the respectively necessary care after German Law and Data Protection. The user acknowledges also the existence and the contents of the data protection explanation of the operator with recognition of the terms and conditions of use.
- Every user is obligated to indicate a current e-mail address, under which he is regularly reachable. Should an e-mail address be found in the user information of an accounts, which cannot be looked at as a valid e-mail address of the user (for example meiermuellerschulze@dumichauch.blubb), the account becomes without regard to contingent cases after §3 sec.2) or 3) deleted. A reimbursement claim does not exist in this case because contact with a real person is not possible through the operator.
- The user has no right at all to the games data of the accounts. If these should become lost for example through a bug or become personally deleted from the Account by the user, he has no claim to restoration. In the case of a system mistake e.g. cancellation of the databases through strange intervention (viruses, hacker etc.) the operator will use hardware problems etc. the respectively last available backup to the Reconstruction of the game data and player data.
- An account applies to all public services of the operator as far as has not been differently arranged.
- In the case of §3 sec.1) or §3 sec.2) every user may possess only ONE account. So named Multi-accounts are forbidden. The action that will be taken in the cases of 'Multis' can be read about in the punishment catalogue.
- Without exception it is not permitted to give login data to other players. Several persons may divide themselves within an account, prefaced, they play everyone only this one account and therefore in conformity with §5 sec.2).
- It is not permitted “to borrow” a Foren Account and from there to post in the forum because Ingame- and Foren account are interconnected and therefore also the login data are transmitted for the Gangwars account to a 3rd person. An offence is punished as accsharing in accordance with punishment catalogue
- An account handover to another user can follow always without statement from reasons. Herewith the data of the new user must be changed by a moderator. The agreement explanation in addition must be sent by the originally registered e-mail address to moderator@gangwars.de. Previous convictions of the previous owner are further valid and become not through the acceptance deleted
- The sale or transmission or the auction of game data, accounts, play money, drinking trough, items or further, the game events influencing virtual objects against real money or a money valued advantage, also in more indirect manner is prohibited. In this context would be on §4 sec.1) referred fall, contingent proceeds therefore the operator even if auctions were prematurely concluded or the buyer had not received the payment caused and/or the salesman this, for whatever reason. Only a maximum of 3 persons in a household can play together. These services are only possible if all concerned Accounts are equipped with Premium Accounts. Transference of this Premium Account on to another user’s Account is later no longer possible. A reimbursement in the case of inactivity, Account change or block is excluded.
- vacation representations for user in the case §3 sec.1) and §3 sec.2) at least two days must be reported before start of the representation over the support form. Only the vacationer itself can apply for a representation.
- The duration must amount to at least 3 days (72 h). Herewith the period of the representation (of/until date) must, as well as the user ID of both players, therefore vacationer AND representation must be indicated. The duration amounts to maximally 8 weeks within a calendar year, a valid Premium account extends the vacation claim by 4 weeks. The regulation steps with the publication effective and applies is to all new vacation proposals from 19.01.2006 target date to the New Year.
- All actions that by these terms and conditions of use are not forbidden are permitted during vacation representations. Forbidden are:
- Attacks under influence with the represented Account
- Buildings to be represented left
- Post building
- Candidacy as a Godfather
- Right to vote for Godfather choice
- Right to vote for Godfather abdication
- Spying (training is permitted)
- All Mafia leader functions (except mafia cash register), especially kick of mafia members
- rights-hands-functions (except mafia cash register)
- Mafia leaving
- Mafia joining
- Mafiakasse auflösen
- Mafia cash register breakup or dispersal
- Mafia cash register roll emptying
- Police patrols bribing
- Judges bribing
- Civil defence arming
- Messenger messages deleting
- Setup changes, especially Setup password change, Setup moving, Setup Account delete, Setup voluntary statements change

- Use bodyguards
- Travelling in with the airplane (except direct flight into the home town)

- Pay Accounts in the pure Pay Cities require no UV.
- The participants must in LAN parties must be reported at least two days before start. The duration may not exceed 5 days. Between end of the last and start of the next LAN party, a distance of at least 14 days must lie between. - The direct or indirect manipulation of the data deposited in the database to the Account is strictly forbidden.
- As such a manipulation, also the using of HTML tricks for the obtaining of game advantages, counts, and/or to the influence of the processing of the petitions to the advantage of the player.
- Just as the utilization of programs to the automatic petition of data falls here under or for the automatic selecting of the contents.
- In disregard of this rule punishments range from the blocking to the DELETION OF ACCOUNT. Herewith is referred especially to the paragraphs 303a and 303b StGB.
- Programs, Scripts etc that receive and automate functions of GW for the player are not permitted. To this for example also belongs the Refresh- Function of the browser Opera. Offenses will be punished with penalties ranging from the blocking of to the Account Deletion.

- Gangwars is not responsible for any material posted on our forums. Gangwars reserves the right to edit or delete material submitted to the forums, but does not assume any obligation to do so. You agree that you will not submit or otherwise publish through our forums any content which: (a) libels, defames, invades privacy, or is obscene, pornographic, abusive, or threatening; (b) infringes any intellectual property or other right of any entity or person, including, but not limited to, violating anyone's copyrights or trademarks; (c) violates any law; (d) advocates illegal activity; or (e) advertises or otherwise solicits funds or is a solicitation for goods or services.
- You agree to indemnify Gangwars and its officers, directors, employees, agents, distributors, and affiliates from and against any and all third party claims, demands, liabilities, costs, or expenses, including reasonable attorney's fees, resulting from your breach of any of the agreements, representations, and warranties set forth in this terms of use
- Spam in every form (e.g. election speechs) can be punished with punishments from the punishment catalogue.
- Offences against the terms and conditions of use become in accordance with the respectively current frame of the punishment catalogue or in especially heavy cases with the end of all operator provided services punished.

- So Far paragraphs of these terms and conditions of use writing, counts § 126 I BGB. The electronic form after § 126 III BGB specifically is excluded. Of the requirement of the writing can be deviated is excluded only through written agreement of the contractual partner, also for this the electronic form
- Invalid clauses in no manner impair the other clauses.
- The English translation of these clauses may be incorrect or incomplete. Therefore only the original version in German language is guilty
